Analysis
 

This initiative, sponsored by Maricopa County Attorney Rick Romley and the Arizona Legislature, adjusts some provisions of the 1996 initiative Proposition 200. That initiative prohibits judges from sending nonviolent drug offenders to prison. As a result, between 25 and 35 percent of offenders mandated into treatment do not comply, according to initiative sponsors.

Proposition 302 would permit judges to use the threat of jail to persuade drug offenders to participate in their court-ordered treatment and would allow judges to jail those who refuse to participate.
